CLIENTS & CASES

  • We represented a construction worker injured on the job site because of OSHA violations. After a seven day jury trial, we received a $346,000 jury verdict with 28% comparative fault for the worker.

  • Robert Fortunati's son Joseph was camping in a remote mountain area. He was killed by the Vermont State Police. Upon hearing the terrible news, Robert drove to the location to discover what happened. The State Police then arrested Robert and charged him with two crimes. After we filed a motion with the court requesting information from the State Police regarding the shooting, the prosecution dismissed all charges against Robert in October, 2006.

  • We defended our client at trial against felony assault charges arising out of a bar fight. We argued that our client acted in self defense. After two minutes of deliberation, the jury agreed and found our client not guilty.

  • A former police chief, Shady Blackwell, charged our client with threatening to murder Mr. Blackwell; assaulting Mr. Blackwell by choking him around the neck; and of resisting arrest. At the jury trial we claimed Chief Blackwell was not telling the truth, and instead without justification, attacked our client, and pepper-sprayed our client's wife in the face. Just before closing arguments and before the State was required to disclose Chief Blackwell's personnel file, the prosecution dismissed all charges.

  • We defended a man accused of threatening his former girlfriend claiming the former girlfriend made false claims in order to gain an advantage in the custody dispute over their son. After a three day jury trial, the jury deliberated for only five minutes and found our client not guilty.

  • On behalf of a wife we obtained a dismissal of a pre-nuptial agreement which gave her only a small share of her husband's substantial assets.

  • We obtained a verdict on behalf of a tenant against a landlord for violation of the Landlord-Tenant Act with an award of attorney's fees.

  • We won a case for a woman against a local bank. The bank committed misconduct, ignoring her rights because they thought her unimportant. We got an award of attorney's fees against the bank.

  • We obtained a reversal of a zoning board's decision for a special exception due to their failure to follow proper procedures.

  • We filed a lawsuit for the estate of an elderly woman against a nursing home. The nursing home was negligent in caring for the elderly woman, causing her terrible personal injuries. The nursing home tried to cover up the woman's injuries and its negligence. We sued for her personal injuries and for punitive damages for the cover-up. After jury selection and just prior to trial, we obtained a confidential settlement for the elderly woman's estate.

  • We represented an employee in a wrongful termination and breach of contract case when he was fired from a large local institution. The institution violated the employee's common law and contract rights. Just prior to trial, we reached a confidential settlement.

  • We represented a young man who was charged with the serious crime of assaulting Lebanon, New Hampshire police officers. Our defense was that the police officers used excessive force and assaulted our client. The jury found our client not guilty of all charges.

  • We represented a group of employees who worked for a large local institution. The employees were not receiving the wages they were entitled to receive. After hearings in front of the New Hampshire Labor Department, our clients were awarded their full wages.

  • We represented the buyer of a mobile home. We claimed the company selling the mobile home violated our client's consumer protection rights. The jury awarded $140,000 for damages and attorneys' fees. In a second trial, the sole shareholder was found personally liable to pay the judgment.

  • We successfully obtained a jury verdict against the real estate company McLaughry Associates for violating consumer protection laws. McLaughry Associates failed to disclose a right of first refusal on the house which it wanted to sell to our client. After a week long trial, the jury awarded our client money damages and attorneys' fees totaling over $60,000.

  • We represented a homeowner against a general contractor who built a garage and apartment for our client. We claimed the general contractor violated consumer protection laws in the construction of the project and violated our client's contract. The jury awarded our client money damages plus attorney's fees totaling over $50,000.

Our clients were unable to use the truck. The manufacturer and truck dealer committed consumer protection violations, fraud and breach of contract. Prior to trial, we settled for $67,000.

  • We represented a woman who suffered a broken leg after she slipped and fell on ice in a business parking lot. We reached a settlement just prior to trial.
